Terms of Service
Last Updated: October 2026 • Effective Immediately
1. Acceptance of Terms
By accessing or using umairyounus.com (“the Website”), communicating with me, or engaging my software engineering consultancy, you agree to comply with and be bound by these Terms of Service. If you disagree with any segment of these terms, you should discontinue use of the website.
Individual client engagements are governed by bespoke Statements of Work (SOW), Master Services Agreements (MSA), or Retainer Agreements, which supersede these website terms in the event of any conflict.
2. Intellectual Property Rights
Website Assets: All proprietary designs, block templates, Tailwind theme implementations, case study narratives, graphics, trademarks, and technical articles published on this website are the intellectual property of Umair Younus, protected under international copyright conventions.
Client Deliverables & Code Ownership: Upon full and final settlement of agreed milestone or retainer invoices, full intellectual property rights, customized source code, and repository ownership for client deliverables are transferred unconditionally to the client, subject to the licensing terms of any underlying open-source frameworks (e.g., WordPress GPL, Laravel MIT, Shopify Theme licenses).
3. Inquiries & Non-Binding Estimates
Information submitted through the project intake form or preliminary consultation discussions does not create a formal contract or binding engineering obligation. Estimates regarding budgets, timelines, and technical architecture are exploratory until formalized into an agreed technical specification and counter-signed contract.
I reserve the right to decline project inquiries where technical requirements fall outside core competencies or where current capacity does not allow for senior-level execution.
4. Third-Party Platforms & Dependencies
Software development projects frequently integrate third-party APIs, SaaS platforms, and cloud infrastructure (including Shopify, WordPress core, Meta Graph APIs, Google Cloud, Stripe, and AWS).
While I engineer custom integrations to the highest standards of resilience, I am not responsible for downtime, breaking API changes, schema deprecations, pricing adjustments, or platform policy alterations instituted by third-party vendors outside my direct control.
5. Warranty & Professional Standard
I provide engineering services with professional care, adhering to modern software engineering best practices, security standards, and performance optimization guidelines.
Project deliverables typically include an agreed warranty window following production launch to resolve unexpected bugs or deviations from agreed specifications. Except as expressly stated in a signed client contract, software deliverables are provided on an “as-is” and “as-available” basis without warranties of uninterrupted functionality across unverified legacy environments.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Umair Younus shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, revenue, data, or business goodwill—arising from website access or software service utilization.
In all circumstances, total liability for any claim arising out of a commercial engagement shall not exceed the total fees paid by the client under the specific SOW giving rise to the claim.
7. Inquiries Regarding Terms
If you have questions regarding these terms, master services agreements, or intellectual property rights, contact me directly at hello@umairyounus.com.
